Cruise was reported to have been completely blindsided by his wife's decision to end their contract marriage and has also filed a petition for sole custody of their 6-year-old daughter.
Holmes has apparently had divorce on her mind for some time, as she secretly rented an apartment in NYC and moved in while her husband, who has been in Iceland filming the movie Oblivion, had no idea what was coming.
According to ABC News both parties "want to settle this matter privately and that talks are ongoing between the two parties."
The first hearing for the case is set for July 17th at the New York Civil Supreme Court and the soon-to-be exes are doing their best to be civil in the interest of their daughter "they have never ruled out trying to reach an amicable settlement," a source told ABC News.
